START WITH A REVIEW

A clear scope.
A personal conversation.

Tell the team where each spouse lives, whether both agree to a mutual consent divorce, and what help you need with documents or coordination.

The applicable law, court jurisdiction, representation and appearance requirements need a review of your circumstances. Remote participation, travel needs and timelines cannot be confirmed from a website questionnaire.

This service focuses on coordination of an Indian matter for couples in Australia. Handling a divorce proceeding in Australia requires a separate review of professional scope and local requirements.

STEP BY STEP

How does the NRI divorce process work?

From the first documents to the final decree, understand each stage of coordinating an Indian mutual divorce matter while living in Australia.

  1. Submit the divorce form and documentation

Share your details and documents digitally. The team reviews the documents, verifies both spouses’ mutual consent and prepares the petition and settlement terms. Notarisation and attestation requirements are confirmed for your circumstances.

  2. File the joint petition

The joint petition is filed before the appropriate Indian Family Court. Where permitted, the team coordinates a Special Power of Attorney (sPOA), an authorised representative or video participation. The court decides which arrangements are available.

  3. First Motion: statements recorded

Both spouses confirm voluntary consent through the appearance arrangements approved by the court. The team considers an application for a cooling-off waiver where applicable.

  4. Cooling-off period or waiver

Follow the applicable waiting period, or proceed under a waiver if the court grants one. The team reviews the requirements and explains the next stage.

  5. Second Motion and decree

Final statements are recorded and the court considers the divorce decree. The team coordinates the approved hearing arrangements, decree collection and delivery.
